A Major Change for Millions of GSM Users
The 11th Judicial Package, submitted to the Turkish Grand National Assembly (TBMM), includes a significant new regulation affecting millions of GSM subscribers across Turkey. AK Party Parliamentary Group Chair Abdullah Güler held a press conference at the Parliament to explain the proposed amendments, officially titled “The Bill Amending the Turkish Penal Code and Certain Other Laws.”
Subscriptions Only With Chip ID Cards
Güler stated that the package introduces new rules for GSM line subscriptions. One of the central changes is that new GSM subscriptions will only be issued using chip-enabled ID cards.
He explained that the Information Technologies and Communication Authority (BTK) will also set a limit on the number of GSM lines a real or legal person can open, aiming to prevent unlimited line registrations used in fraud schemes.
3-Month Checks on Deceased or Closed Entities’ Lines
Another key provision is the periodic checking of GSM lines belonging to:
- individuals who have passed away
- legal entities that have been dissolved
These lines will be reviewed every three months, and inactive or irregular lines will be closed.
Standards for Foreign Nationals’ Mobile Lines
Güler also noted that new standards will apply to mobile lines owned by foreign nationals. Diplomatic personnel and foreign mission staff will be exempt from these rules.
Cutting Off Lines Used in Crime
The package includes a measure to disconnect any GSM line found to be used in:
- fraud
- theft
- misuse of bank or credit cards
These lines will have their network access terminated as a preventive measure.
Penalties for Not Providing Data on Time
During any criminal investigation or prosecution, if banks, financial institutions, or GSM operators fail to submit requested documents or information within 10 days, they will face administrative fines.
Transition Period and Consumer Protection
Güler emphasized that consumers—both citizens and foreign nationals—will be given time to:
- update their subscription records
- transfer lines to their own name
- or cancel unused lines
He also stated that no additional costs will be passed on to consumers during this transition.
Additionally, the bill proposes moving the jurisdiction of fraud cases under Article 158 of the Turkish Penal Code to criminal courts of first instance, allowing these courts to specialize and process cases more efficiently.
