AIRBNB TURKEY TAX PROBLEMS

The US-based accommodation application Airbnb allows individuals to rent all or part of their homes for short or long periods. The application is also preferred by tourists looking for short-term accommodation.

On July 31, Culture and Tourism Minister Mehmet Nuri Ersoy first mentioned that they would introduce a certification requirement for homes rented on a daily basis adding “They will have to obtain a certificate from the Ministry of Culture and Tourism and will be obliged to regularly report the guests staying there. There will also be a tax on the income they generate.”

The regulation was presented to the Parliament on October 10 and was enacted on October 20

According to the regulation published in the Official Gazette today, those who rent housing for tourism purposes without a permit certificate will be fined 100,000 Turkish Lira for each property. They will be given a 15-day period to obtain a permit certificate to continue their activities. This will impose tax obligations on homeowners.

Those who continue to rent for tourism purposes without obtaining a permit certificate after the 15-day period will be fined 500,000 Turkish Liras. They will be given another 15-day period to obtain a permit certificate for resuming their activities. If the activities continue after this period, a fine of 1 million Turkish Liras will be imposed.

Penalties for those who rent to others

Those “who rent the rented property to others” will be subject to an administrative fine of 100,000 Turkish Liras for each contract.

Those who mediate in the rental of housing for tourism purposes without a permit certificate will be subject to an administrative fine of 100,000 Turkish Liras for each contract.

For those who make rental agreements for more than 100 days, and rent the same property more than four times within a year from the date of the first contract, an administrative fine of 1 million Turkish Liras will be imposed.

Approval of all residents required

The presentation of a decision taken unanimously by all apartment owners of the building is mandatory for obtaining a permit certificate.

In housing complexes (siteler with multiple buildings), this condition will only apply to buildings where there is a rented apartment or residence. A sample permit certificate will be submitted to the site management.

In buildings consisting of more than three independent sections, a permit certificate can be issued for a maximum of 25% in the name of the same lessor.
