AIRBNB TURKEY TAX PROBLEMS

After the Turkish Grand National Assembly (TBMM) started its new legislative year as of October 1, details of the proposed law regarding daily rented homes have begun to become clear.

Details of the proposed law for daily rented homes have been shared. According to this, if those who engage in daily rentals do not comply with the rules, a fine of nearly 1 million Turkish Lira per apartment is planned to be imposed. Additionally, if the rental property is within an apartment building, permission will be required from neighbors. If even one person does not approve, the homeowner will not be able to engage in daily rentals.

The regulation regarding daily rental homes is planned to be submitted to the Parliament within this month. According to Sabah’s news, both those who rent out daily rental homes and those who rent them will be responsible. Those who want to rent out their property in this way will obtain a “tourism residence” permit from the Ministry of Culture and Tourism, and display it in front of their door. Those who do not obtain this permit will not be able to rent out their property on a daily basis.

IF NEIGHBORS DO NOT APPROVE, IT CANNOT BE RENTED

In addition, those who want to obtain the permit will be required to fulfill certain conditions. If the legal regulation is enacted, homeowners who rent their properties will be required to obtain permits such as fire escape, fire report documents, and waste control certificates.

Properties will also be required to have mandatory items found in hotels (hairdryer, towels, bedding, etc.). If the property to be rented is within an apartment building, a consent form will be required from the neighbors. If even one person does not approve, the homeowner will not be able to engage in daily rentals.

UP TO 1 MILLION TURKISH LIRA FINE

After the law is enacted, those engaged in daily rentals who do not comply with the rules will face penalties. A fine of nearly 1 million Turkish Lira per apartment is planned to be imposed. Additionally, if the documents are not completed and it is determined that the rental is still ongoing, the property will be sealed.

IDENTIFICATION INFORMATION TO BE SUBMITTED

With the new regulation, just like in hotels, the identification information of the person renting out the property and the duration of the stay will be submitted to the police.

An interface will be opened via e-government for this purpose. Homeowners who do not provide this information will be held responsible and face penalties. Inspection mechanisms related to this will be accelerated.
