Information Technologies and Communication Authority brings new regulation on social media

Information Technologies and Communication Authority has introduced detailed regulations on social networks such as Twitter, Instagram, Facebook. According to this, user information must be hosted in Turkey and provided to the prosecutor if deemed necessary. By the judge’s decision, a band-narrowing penalty of up to 90 percent can be given. The decision will be implemented within 4 hours.

The Information Technologies and Communication Authority has determined the procedures and principles about social network providers such as Twitter, Instagram, Facebook, etc.

“Some” of the obligations imposed in the decision prepared on the basis of the Law of 2007 on the Regulation of Publications Made on the Internet and the Fight against Crimes Committed Through These Publications are as follows:

=> The network provider hosts the data of users in Turkey in Turkey.

=> The social network provider shares this content and information about the creator of the content with the authorized law enforcement units if it is inconvenient for people to learn and delay the contents that endanger the safety of life and property.

=> The institution may request all kinds of explanations from the network provider, including corporate structure, information systems, algorithms, data processing mechanisms and commercial attitudes.

=> The information necessary to reach the perpetrators who create or distribute Internet content such as Sexual abuse of children in the Turkish Penal Code, spreading misleading information publicly, disrupting the unity of the state and the integrity of the country, extremes against the Constitutional order and the functioning of this order or subject to espionage crimes is provided to the judicial authorities by the public prosecutor at the investigation stage, upon request by the court at the prosecution stage, by the representative of the relevant social network provider in Turkey.

=> In case of violation of the obligation to provide information to judicial authorities, the public prosecutor may apply to the court with a request to reduce the internet traffic bandwidth of the social network provider by 90 percent.

=> If a narrowing decision is made, it will be fulfilled by the access providers within 4 hours at the latest.
