Unbelievable development in Turkey’s Judiciary System: Criminal Complaint Against Constitutional Court Members by Court of Cassation

The Court of Cassation has filed a criminal complaint against the members of the Constitutional Court, alleging that they violated the constitution with their decision regarding Can Atalay. The Court of Cassation also decided to send a copy of the decision to the Turkish Grand National Assembly (TBMM) to initiate the process of removing Atalay’s parliamentary status.

Following the Constitutional Court’s decision regarding Can Atalay, the examination of the case by the 3rd Criminal Division of the Court of Cassation has been completed.

The Division decided not to comply with the Constitutional Court’s violation decision regarding Can Atalay and also decided to send a copy of the decision to the TBMM to start the proceedings for the removal of Atalay’s parliamentary status, and to file a criminal complaint against the members of the Constitutional Court who issued the violation decision.

The decision shared by the court included following as well: “In accordance with the findings in the file, a criminal complaint is to be FILED WITH THE COURT OF CASSATION PROSECUTOR’S OFFICE for the relevant members of the Constitutional Court who voted in favor of violating constitutional provisions and exceeded their authorized limits in an unlawful manner, resulting in a violation of rights.

The decision was unanimously adopted on 08.11.2023.”

This is considered to be a shocking development by many opinion leaders.
