Constitutional Court decides to accept indictment for closure of HDP party

COURT ACCEPTS INDICTMENT FOR CLOSURE HDP

HDP (political party) indictment accepted – Turkey’s Constitutional Court, which completed its initial review of the case, reopened with a request for closure of the HDP, decided to accept the indictment.

The indictment, which the High Court returned with a request to complete the deficiencies, was re-prepared by the prosecutor general’s Office of the Supreme Court and sent to the Constitutional Court.

CAN BE MADE WITH MAJORITY OF VOTES OF 10 MEMBERS OUT OF 15

A 15-member Constitutional Court panel will decide the closure case against the HDP. Due to points mentioned in provision 69 of the Constitution, a decision can be made to close said party or deprive it partially or fully of state aid depending on the importance of the actions subject to the case with 10 members minimum of the 15 members court.

The decision made as a result of the case for closure of the political party will be communicated to the Chief Prosecutor of the Supreme Court, concerned political party and and published in the Official Gazette.

If the Constitutional Court determines that the statements and actions of the parties requested to be closed, these people will not be the founder, member, manager and auditor of another party for 5 years, starting with the justified publication of the final decision in the Official Gazette.
