Minister of Justice: “Practice of compulsory mediation in rent cases is starting”

Minister of Justice Yılmaz Tunç reminded that the regulation imposing a 25 percent increase limit on rents had been extended until July 1, 2024 and said, “The ‘mandatory mediation’ implementation will start in rent cases, on September 1. It will be mandatory to contact a mediator before filing a lawsuit related to the rental price or eviction.”

Justice Minister Yilmaz Tunc answered the questions of the press members after the Cabinet meeting.

“MEDIATION WILL START ON SEPTEMBER 1ST

Tunç, upon being reminded of the regulation that imposed a 25 percent increase limit on rents, spoke as follows:

“With the temporary article added to the Code of Obligations last year, the annual rent increase in housing rental agreements was limited to a maximum of 25 percent. With the legal arrangement realized in the Grand National Assembly of Turkey, this period has been extended for another 1 year starting from July 1. Annual rent increase in residential rental agreements will not exceed 25 percent until July 1, 2024. On September 1, the ‘compulsory mediation’ period will begin in rent cases. It will be mandatory for the tenant or lessor to contact an intermediary before filing a lawsuit related to the rental price or eviction.

The settlement of rent disputes through mediation without going to court will allow the parties to reconcile with less costs and a faster and more peaceful method. In this case, the workload of the courts will also be reduced.”
