The Council of Europe warns Turkey about Kavala and Demirtas cases

The committee of Ministers of the Council of Europe has warned for the first time to launch an infringement procedure against Turkey on the grounds that Turkey does not comply with the decisions of the European Court of human rights (ECHR) on Osman Kavala.

As reported by DW, the committee of Ministers of the Council of Europe which oversees the implementation of the ECtHR’s decisions, noted that the Kavala decision announced by the ECHR on 10 December 2019 and finalized in May this year has not been implemented and announced that it will initiate the process of violating the European Convention on Human Rights (ECHR) on Turkey if the arbitrary detention of Kavala continues.

At the last meeting of the committee of Ministers of the Council of Europe in Strasbourg, of which Turkey is a member, the situation of businessman Osman Kavala who has been in prison for 3.5 years, was once again mentioned. Previous calls in published result statement was reminded and it was stated that Kavala’s continued detention was contrary to international law and he should be released immediately.

One of the tools likely to be used in this context is the suspension of Turkey’s right to vote and veto in the Council of Europe when the infringement procedure is initiated.

A PERIOD UNTIL 22 JUNE GRANTED FOR DEMIRTAŞ CASE

Meanwhile a lawyer for former HDP co-chairman Selahattin Demirtas, announced on his Twitter account that the committee of Ministers of the Council of Europe had given Turkey until June 22 to “submit an action plan, including measures taken to strengthen judicial independence” for the decision regarding Selahattin Demirtas non-implemented.
