“Genocide” case against Israel begins in the Hague, in Netherlands

GENOCIDE CASE DEN HAGUE ISRAEL

The preliminary hearing for the lawsuit brought by the Republic of South Africa against Israel in the International Court of Justice (ICJ), alleging that Israel violated the Genocide Convention with its actions in Gaza, has begun. The hearing, where the precautionary measures requested by South Africa will be discussed, is being held publicly in the ICJ located in The Hague, Netherlands. Today’s session will address South Africa’s requests for precautionary measures, while the Israeli delegation will present its defense in tomorrow’s session.

The session began with a presentation by Professor John Dugard, a prominent legal figure representing South Africa, who actively opposed apartheid during that era. South Africa submitted a written application on December 29, requesting the court to issue 9 precautionary measures against Israel.

Among the precautionary measures sought by South Africa are an immediate cessation of Israel’s military operations in Gaza, taking necessary measures to prevent genocide against Palestinians, ensuring access to humanitarian aid, including food, water, fuel, medical and hygiene supplies, shelter, and clothing for those displaced to return to their homes. The requested measures also include taking necessary steps to punish those involved in genocide, preserving evidence of genocide, and submitting regular reports to the ICJ regarding the implementation of the measures.

In accordance with Article 9 of the 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide, any state party to the convention can file a case in the ICJ against a violating state. South Africa filed a lawsuit on December 29 at the ICJ, alleging that Israel violated the Genocide Convention with its actions in Gaza since October 7. Many countries, including Turkey, and international organizations, including the Organization of Islamic Cooperation, have expressed support for the case.
